Occupant Ejection

It’s well established that drivers and passengers are much more likely to be killed or seriously injured in an accident if they are thrown from their vehicles during a crash. The National Highway Traffic Safety Administration cites studies showing that partially or completely ejected passengers are three times as likely to die as those who are able to remain in the vehicle. Due to the high probability of being slammed hard against an object on impact, they are also much more likely to sustain serious injuries such as a traumatic brain injury, spinal injuries, paralysis, amputation, internal bleeding and multiple fractures.

Unfortunately, the chance of being thrown from a vehicle is sometimes artificially increased by defects in an automobile or one of its parts. For example, the NHTSA cites seatbelt use as the number-one way to keep from being thrown from the vehicle in an accident. However, when the vehicles seat belts are defective, occupants don’t have the protection they thought they had. In an accident, a defective seat belt could fail, increasing the user’s chance of a serious injury or death. Another dangerous defect that is highly likely to lead to occupant ejection is a faulty door latch. When a door flies open without warning or fails in an accident, it creates a gaping safety hole that allows occupants to fly unprotected through the air and sustain a serious injury.

Because a rollover accident violently turns occupants over and throws them around, it is also a major cause of vehicle ejection accidents. Half of all deaths in rollover accidents result from being ejected from the automobile. Unfortunately, rollovers are a very common result of automobile and auto part design defects. The probability of a rollover increases in many flawed sport-utility vehicles and 15-passenger vans, due to those vehicles’ higher center of gravity, inability to handle heavy cargo and the special skills their drivers may need.

If you or someone you love has been thrown from a vehicle with design flaws, you are entitled to hold the designers liable for your injuries through the legal system.
